US Judge Mandates Release of Abrego Garcia from ICE Detention
A court has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without legal authority.
"Since his release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.
The situation originates in a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an mistake. After his repatriation to the United States to face alien smuggling charges, he was held in immigration detention.
In her decision, the court pointed out that the government lacks a valid deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
